TERMS AND CONDITIONS OF SALE AND WEBSITE USE
Last updated: 25 July 2026
- COMPANY INFORMATION
This website, available at www.jolston.co.za (“the Website”), is owned and operated by:
Jolston Systems (Pty) Ltd
Registration number: 2026/451049/07
Physical address: 2 Venus Street, Sharonlea, Randburg, Johannesburg, South Africa
Email address: info@jolston.co.za
Telephone number: +27 (0) 60 508 2335
In these Terms and Conditions, “Jolston”, “we”, “us” and “our” refer to Jolston Systems (Pty) Ltd. “Customer”, “consumer”, “you” and “your” refer to any person who accesses the Website, creates an account, requests a quotation or purchases goods or services through the Website.
- ACCEPTANCE OF THESE TERMS
By accessing the Website, creating an account, submitting an order or purchasing goods or services from us, you agree to be bound by these Terms and Conditions and any policies incorporated into them, including our:
- Privacy Policy;
- Returns and Refund Policy;
- Delivery Policy;
- Cancellation Policy; and
- Cookie Policy.
Nothing in these Terms is intended to limit or exclude any right that cannot lawfully be limited or excluded under South African law, including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002.
Where any provision of these Terms conflicts with a mandatory provision of applicable legislation, the legislation will prevail.
- ELIGIBILITY AND AUTHORITY
You must have the legal capacity to enter into a binding agreement.
Where you place an order on behalf of a company, organisation or another person, you warrant that you are authorised to bind that entity or person to the transaction.
A minor may use the Website or place an order only with the assistance or consent of a parent or legal guardian, where required by law.
- WEBSITE USE
You may use the Website only for lawful purposes.
You may not:
- use the Website for unlawful, fraudulent or unauthorised purposes;
- introduce viruses, malware or other harmful code;
- attempt to gain unauthorised access to the Website or its systems;
- scrape, reproduce or commercially exploit Website content without written permission;
- interfere with the Website’s security or operation;
- submit false or misleading information;
- impersonate another person; or
- infringe our intellectual property rights or those of another person.
We may suspend or terminate access where we reasonably believe that a user has breached these Terms or used the Website unlawfully.
- PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, specifications, photographs, measurements, prices and availability are accurate.
Product images are provided for illustrative purposes. Colours and appearance may vary because of screen settings, lighting, manufacturing variations or product updates.
Measurements and specifications may be subject to reasonable manufacturing tolerances.
Where a product is materially different from its description, your rights under applicable South African consumer legislation will remain unaffected.
- PRICES AND VAT
All prices are stated in South African rand unless indicated otherwise.
Prices are:
Exclusive of VAT because Jolston Systems (Pty) Ltd is not currently registered for VAT.
Delivery charges, installation charges and other applicable fees will be shown separately before the order is completed, where applicable.
We may change prices at any time, but a price change will not ordinarily affect an order that we have already accepted, except where:
- the displayed price was an obvious error;
- the product or quantity was incorrectly described;
- a system or data-capture error occurred; or
- the law requires a price adjustment.
If an obvious pricing error affects an order, we will notify you and give you the opportunity to proceed at the correct price or cancel the affected item for a full refund.
- ORDERS AND CONTRACT FORMATION
Products displayed on the Website constitute an invitation to submit an order and are not necessarily a binding offer by Jolston.
You make an offer to purchase when you submit an order and complete the required checkout process.
An automated order acknowledgement confirms that we received your order. It does not necessarily mean that the order has been accepted.
An order is accepted when we:
- send you an express order-confirmation or dispatch-confirmation notice; or
- begin preparing, manufacturing or dispatching the goods,
whichever occurs first.
We may decline or cancel an order where:
- the product is unavailable;
- payment has not been authorised or received;
- there is an obvious pricing or description error;
- we reasonably suspect fraud or unlawful activity;
- delivery cannot reasonably be completed to the supplied address;
- an order exceeds a stated quantity limitation; or
- accepting the order would breach applicable law.
If we cancel an order after receiving payment, we will refund the amount paid for the cancelled goods.
- CUSTOMER INFORMATION
You must provide complete and accurate billing, contact and delivery information.
You are responsible for checking:
- the products and quantities ordered;
- product variations and specifications;
- personalisation or customisation instructions;
- the delivery address;
- contact details; and
- any artwork, files or measurements supplied to us.
We will not be responsible for delays or additional costs caused by materially incorrect information supplied by you, except to the extent that the law provides otherwise.
- PAYMENT
Available payment methods will be displayed during checkout.
Payment may be processed by third-party payment service providers. Those providers may process payment information under their own terms and privacy policies.
We do not ordinarily store complete payment-card details on our systems.
Orders may be held until payment has cleared or payment authorisation has been confirmed.
Where payment is reversed, disputed or found to be fraudulent, we may suspend fulfilment and take reasonable steps to recover goods or amounts lawfully due.
- CANCELLATION BEFORE DISPATCH
You may request cancellation by contacting info@jolston.co.za as soon as possible.
An ordinary, non-customised order may be cancelled without charge before it has been packed, dispatched or specially procured.
Once an order has been dispatched, it will normally be handled as a return rather than a pre-dispatch cancellation.
Where goods have been specially ordered, manufactured, altered, assembled, branded, engraved, cut, configured or personalised for you, cancellation may be refused once production or procurement has commenced, to the extent permitted by law.
Where permitted by the Consumer Protection Act, we may deduct a reasonable cancellation charge that reflects actual work performed, materials committed, administrative costs and other reasonable losses arising from the cancellation.
No cancellation fee will be imposed where cancellation results from our breach, failure to deliver as agreed or inability to fulfil the order.
- ELECTRONIC-TRANSACTION COOLING-OFF RIGHTS
Where section 44 of the Electronic Communications and Transactions Act applies, a consumer may cancel an eligible electronic transaction:
- for goods, within seven days after receiving the goods; or
- for services, within seven days after concluding the agreement.
The consumer may be responsible only for the direct cost of returning the goods, where permitted by law.
The statutory cooling-off right may not apply to transactions excluded under the Electronic Communications and Transactions Act, including certain:
- personalised or specially made goods;
- goods whose price depends on financial-market fluctuations;
- perishable or rapidly deteriorating goods;
- opened audio, video, software or similar products;
- newspapers, periodicals or magazines;
- accommodation, transport, catering or leisure services arranged for a specific date or period; and
- other goods or services excluded by applicable legislation.
This clause does not limit any separate right relating to defective, unsafe, incorrect or misdescribed goods.
- DELIVERY POLICY
12.1 Delivery area
We deliver to valid physical addresses within South Africa, subject to courier coverage and any restrictions disclosed during checkout.
We do not deliver to post-office boxes.
Remote or outlying areas may attract additional charges or longer delivery periods.
12.2 Delivery providers
We generally arrange deliveries through The Courier Guy, including bookings facilitated through Bob Go, or another reputable courier where reasonably necessary.
We may select the appropriate courier service based on the delivery address, parcel size, parcel weight, service availability and delivery requirements.
12.3 Delivery charges
Delivery charges are calculated according to factors that may include:
- destination;
- parcel dimensions;
- parcel weight;
- selected service level;
- insurance or special-handling requirements; and
- whether the address is in a main centre, regional area or remote area.
The applicable charge will be displayed during checkout or included in a quotation.
Additional charges may apply where incorrect dimensions, weights or delivery details were supplied by the customer.
12.4 Delivery estimates
Any delivery date or transit period shown on the Website is an estimate unless we expressly agree to a specific date in writing.
Estimated delivery periods normally begin once:
- payment has cleared;
- the order has been accepted;
- any required artwork or specification has been approved; and
- the goods are ready for dispatch.
Manufacturing, processing or lead time is separate from courier transit time.
We will make reasonable efforts to deliver on the agreed date, at the agreed time and to the agreed place, as required by applicable law.
12.5 Courier delays
Courier delays may occur because of weather, road closures, strikes, service interruptions, public holidays, peak-season volumes, incorrect addresses or other circumstances beyond reasonable control.
We will provide reasonable assistance with tracking and courier enquiries. Using an external courier does not remove any responsibility that Jolston has under applicable consumer law.
12.6 Delivery address and access
You must provide a complete physical delivery address and a valid contact number.
You must ensure that:
- somebody is available to receive the parcel;
- the courier has reasonable access to the premises; and
- any security, estate, complex or access instructions are supplied in advance.
We may charge reasonable additional delivery costs where a delivery fails because:
- the address was materially incorrect or incomplete;
- nobody was available after reasonable delivery attempts;
- access was refused or unavailable; or
- the customer requested redirection after dispatch.
12.7 Inspection on delivery
You should inspect the outer packaging when delivery takes place.
Visible damage, tampering, shortages or incorrect parcels should be recorded on the courier’s delivery documentation where possible and reported to us promptly.
Signing a delivery record does not remove any statutory rights relating to concealed damage, defects or incorrect goods.
12.8 Risk and ownership
Risk in the goods remains with Jolston until the goods have been delivered to you or to a person authorised by you to receive them, subject to applicable law.
Ownership passes only once we have received full payment for the goods.
Where you independently appoint and pay a carrier that was not offered or arranged by Jolston, risk may pass as provided by applicable law.
12.9 Failure to deliver
If we cannot deliver within the agreed period, we will contact you and propose a revised delivery arrangement.
Where applicable law permits you to cancel because we failed to deliver as agreed, you may cancel without penalty and receive a refund of the relevant amount paid.
- RETURNS AND REFUNDS POLICY
13.1 Return authorisation
Before returning goods, contact us at info@jolston.co.za and provide:
- your order number;
- your name and contact details;
- the product concerned;
- the reason for return;
- photographs or video where damage or a defect is alleged; and
- any other information reasonably needed to assess the return.
We will provide return instructions and, where applicable, a return reference.
Sending an item back without contacting us may delay inspection or processing.
13.2 Defective or unsafe goods
Goods are supplied subject to the statutory warranty of quality under the Consumer Protection Act where that Act applies.
If goods fail to meet the applicable standards of quality, safety, durability or fitness within six months after delivery, the consumer may, subject to the CPA, return the goods at the supplier’s risk and expense and choose to have the goods:
- repaired;
- replaced; or
- refunded.
The available remedy may depend on the circumstances and applicable legislation.
If repaired goods fail again within the period contemplated by the CPA, the consumer may have further rights to a replacement or refund.
The statutory warranty may not apply where:
- the defect resulted from misuse, abuse, negligence or accidental damage;
- the goods were altered, repaired or installed by an unauthorised person;
- reasonable maintenance instructions were not followed;
- the defect arose from normal wear and tear;
- the customer expressly accepted goods in a disclosed condition; or
- another lawful exclusion applies.
Any manufacturer’s warranty is additional to, and does not replace, rights under the CPA.
13.3 Incorrect goods
If we deliver goods that differ materially from what you ordered, contact us promptly.
Once verified, we will arrange collection or provide reasonable return instructions at our cost and will, as appropriate:
- deliver the correct goods;
- replace the goods; or
- refund the relevant amount.
13.4 Goods damaged during delivery
Damage arising before or during delivery must be reported as soon as reasonably possible, preferably within 48 hours, so that we can lodge a courier claim and preserve evidence.
Failure to report within 48 hours does not automatically remove statutory rights, but may make it more difficult to establish when and how the damage occurred.
Please retain:
- the product;
- all original packaging;
- courier labels;
- accessories; and
- photographs of the parcel and damage.
Do not dispose of packaging until the matter has been resolved.
13.5 Change-of-mind returns
In addition to any mandatory statutory cooling-off right, Jolston may accept an ordinary change-of-mind return where:
- the request is made within 7 days after delivery;
- the goods are unused, uninstalled and undamaged;
- the goods are in a resalable condition;
- all packaging, manuals, parts and accessories are included;
- the goods were not personalised or specially ordered; and
- proof of purchase is provided.
Unless the law requires otherwise:
- return courier costs for a voluntary change-of-mind return are payable by the customer;
- original delivery charges may be non-refundable;
- responsibility for the parcel remains with the customer until it is received by Jolston; and
- a reasonable deduction may be made for diminished value caused by unnecessary handling, damage, missing packaging or missing accessories.
13.6 Non-returnable goods
Subject always to mandatory statutory rights, the following goods will ordinarily not be accepted for a change-of-mind return:
- personalised, branded, engraved or custom-manufactured goods;
- specially procured goods;
- goods cut or altered to customer specifications;
- opened software or licence products;
- downloadable or digitally supplied products once supply has commenced with the customer’s consent;
- goods that cannot be resold for hygiene or health reasons once unsealed;
- perishable goods;
- clearance goods sold with disclosed defects;
- installed, used or materially damaged goods; and
- goods missing serial numbers, parts, accessories or original packaging.
These exclusions do not apply where goods are defective, unsafe, incorrectly supplied or otherwise returnable by law.
13.7 Assessment
Returned goods may be inspected or tested before a remedy is approved.
Inspection is intended to establish:
- whether the correct product was returned;
- the nature and cause of an alleged defect;
- whether goods have been used or damaged;
- whether all parts are present; and
- which remedy is legally and practically appropriate.
An inspection fee will not be charged merely for exercising a valid statutory right. However, reasonable costs may be charged where legally permissible and where inspection shows that the product is not defective and was damaged through misuse, unauthorised alteration or another cause attributable to the customer.
13.8 Refund method and timing
Approved refunds will normally be made to the original payment method.
We may request reasonable verification before processing a refund.
Refunds are generally processed within 7 to 10 business days after:
- cancellation has been approved; or
- returned goods have been received and inspected,
depending on the reason for the refund.
Banks and payment providers may require additional processing time after we release the refund.
A refund will not be made to an unrelated third party unless required or permitted by law and adequate verification has been completed.
- SERVICES, INSTALLATION AND CUSTOMER-SUPPLIED INFORMATION
Where we provide services, installation, configuration, design, development or other work, you must provide accurate information and reasonable access necessary for performance.
You must review and approve any specifications, proofs, artwork, designs, measurements or configurations before production or implementation.
Approval confirms that you have checked the relevant content, including spelling, layout, dimensions, quantities and specifications.
This does not excuse Jolston from responsibility for failing to follow an approved specification or from any obligation that cannot legally be excluded.
- WARRANTIES AND LIMITATION OF LIABILITY
Nothing in this clause excludes or limits liability where doing so would be prohibited by the Consumer Protection Act or another applicable law.
To the maximum extent permitted by law:
- the Website is provided on an “as available” basis;
- we do not guarantee that the Website will always be uninterrupted or error-free;
- we are not responsible for losses caused solely by circumstances beyond our reasonable control;
- we are not liable for indirect, special or consequential loss that was not reasonably foreseeable when the agreement was concluded; and
- our aggregate liability arising from a transaction will ordinarily be limited to the amount paid for the affected goods or services.
The above limitations do not apply to liability that cannot legally be limited, including liability arising from gross negligence, fraud, wilful misconduct, unsafe goods or other grounds protected by applicable legislation.
- THIRD-PARTY SERVICES AND LINKS
The Website may use or link to third-party platforms, payment providers, courier systems, mapping tools or other external services.
We do not control third-party websites and are not responsible for their independent content, availability, privacy practices or terms.
This clause does not remove any responsibility Jolston may have for third parties used by us to fulfil our obligations to you.
- USER CONTENT AND REVIEWS
Where you submit reviews, photographs, suggestions or other content, you warrant that:
- you own the content or have permission to submit it;
- it is accurate to the best of your knowledge;
- it does not infringe another person’s rights;
- it is not unlawful, defamatory, abusive or malicious; and
- it does not contain harmful code.
You grant Jolston a non-exclusive, royalty-free licence to display and use submitted content for operating and promoting our business, subject to applicable privacy law.
We may remove content that reasonably appears unlawful, misleading, offensive or in breach of these Terms.
- INTELLECTUAL PROPERTY
All Website content including text, graphics, logos, photographs, layouts, software and product information is owned by or licensed to Jolston and is protected by applicable intellectual-property laws.
You may view and use the Website for personal or legitimate business-purchasing purposes.
You may not reproduce, modify, distribute, sell, scrape or commercially exploit Website content without prior written permission.
- PERSONAL INFORMATION AND POPIA
We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 and our Privacy Policy.
Personal information may be processed for purposes including:
- creating and managing accounts;
- processing orders and payments;
- delivering goods;
- communicating with customers;
- preventing fraud;
- complying with legal obligations;
- handling returns and warranties; and
- marketing where lawful consent or another lawful basis exists.
We may share necessary information with payment providers, couriers, hosting providers and other operators that assist us in providing the services.
Our Privacy Policy explains the categories of information processed, processing purposes, retention, security measures, data-subject rights and contact details for privacy enquiries.
- ERRORS AND AVAILABILITY
We may correct typographical errors, inaccurate product information, pricing errors, stock errors or other omissions.
Where an error materially affects an order already placed, we will notify you and provide an appropriate choice, which may include proceeding on corrected terms or cancelling the affected product for a refund.
We do not guarantee that every product displayed will remain available.
- FORCE MAJEURE
Neither party will be liable for a failure or delay caused by circumstances beyond its reasonable control, including severe weather, natural disaster, civil unrest, strikes, transport interruption, load shedding, telecommunications failure, cyberattack, epidemic, government restriction or supplier disruption.
The affected party must take reasonable steps to reduce the delay.
If performance becomes impossible or is delayed for an unreasonable period, the customer may have cancellation and refund rights under applicable law.

Complaints should first be submitted to:

Please include your order number and a clear description of the complaint.

Nothing in these Terms prevents a consumer from referring a matter to the National Consumer Commission, a provincial consumer authority, an applicable ombud, the Consumer Goods and Services Ombud, the Information Regulator, the National Consumer Tribunal or a court with jurisdiction.

A party must notify the other of changes to its relevant contact details.
- GOVERNING LAW AND JURISDICTION
These Terms, the Website and all transactions concluded through the Website are governed by the laws of the Republic of South Africa.
Any dispute will be subject to the jurisdiction of a competent South African court, tribunal, ombud or regulatory body.
Nothing in this clause prevents a consumer from exercising a right to approach a forum made available under the Consumer Protection Act or other applicable legislation.
- SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be severed or limited to the minimum extent necessary.
The remaining provisions will continue in effect.
- NO WAIVER
A failure or delay by Jolston to enforce any provision does not constitute a waiver of that provision or any other right.
- ENTIRE AGREEMENT
These Terms, together with the order, quotation and policies expressly incorporated into them, constitute the agreement between Jolston and the customer concerning the relevant transaction.
They replace prior representations concerning the same subject matter, except for representations or rights that cannot lawfully be excluded.
- CHANGES TO THESE TERMS
We may update these Terms from time to time by publishing the revised version on the Website and changing the “Last updated” date.
Changes will apply prospectively unless the law permits or requires otherwise.
